These Terms and Conditions (“Terms”) govern your access to and use of the Varsha mobile application, website at varsha.chat, and related services (collectively, the “Services”) operated by Varsha (“we,” “us,” or “our”).

By downloading, installing, creating an account, or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

Varsha is your private 24/7 AI companion for text chats in Hindi, English, and Hinglish. Voice notes, video, and mood switching are coming soon.

Meet Varsha — your personal AI companion who is always here to listen, share, and connect with you. Whether you want to share your heart out in Hindi, English, or Hinglish, Varsha understands your language, emotions, and late-night thoughts.

Varsha provides interactive entertainment and digital companionship. It is not a substitute for professional therapy, medical advice, psychiatric care, or emergency mental health services.

3. Eligibility

You must be at least 13 years old to use the Services. By using Varsha, you represent and warrant that:

Varsha may remember details you share in conversation or that you add manually, to personalize future chats. You can view and delete memories from your profile where available.

5.4 Premium access

Certain features, including unlimited messaging and premium media, may require a paid subscription. Introductory offers (including plans starting at ₹1, where available) are subject to eligibility and may change.

Free-tier users may have daily or monthly message limits.

6. Subscriptions and Payments

Premium subscriptions may be purchased through:

10. Intellectual Property

The Services, including the Varsha name, logo, app design, software, and AI character, are owned by us or our licensors and protected by intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

You retain ownership of content you submit. By sending messages, you grant us a license to process that content solely to provide and improve the Services as described in our Privacy Policy.

11. Third-Party Services

The Services integrate with third parties such as Google Sign-In, Razorpay, Google Play, and Groq. Your use of those services is subject to their respective terms and policies. We are not responsible for third-party services outside our control.

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that:

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ₹1,000.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Services, your content, or your violation of these Terms or applicable law.

15. Account Termination

You may stop using the Services at any time. You can delete your account immediately in the App under Settings → Delete account, or by following the instructions at https://varsha.chat/delete-account. You may also email scisaif1@gmail.com.

We may suspend or terminate your access if you violate these Terms, create risk or legal exposure for us, or if we discontinue the Services. Upon termination, provisions that by nature should survive (including disclaimers, limitation of liability, and dispute resolution) will remain in effect.

16. Changes to the Services and Terms

We may modify, suspend, or discontinue any part of the Services at any time.

We may update these Terms from time to time. Material changes will be communicated through the App, on varsha.chat, or by other reasonable means. Continued use after the effective date of updated Terms constitutes acceptance.

17. Governing Law and Disputes

These Terms are governed by the laws of India, without regard to conflict-of-law principles.

Any dispute arising from these Terms or the Services shall be subject to the exclusive jurisdiction of the courts in India, unless applicable consumer protection law requires otherwise.
